This Waiver applies whenever a guardian creates an account for a minor, submits a session request, books, pays for, attends, or allows a minor to participate in a training session arranged through BullDawg.
By using BullDawg for a minor participant, you agree to this Waiver for yourself and for the minor participant to the fullest extent permitted by law.
BullDawg is a marketplace that connects guardians with independent trainers. BullDawg does not provide the underlying training services and does not supervise, control, or direct the trainer's conduct during a session.
Athletic training, conditioning, skills instruction, and related physical activities involve inherent and significant risks, including risks of serious personal injury, illness, disability, emotional distress, property damage, and death. Risks may arise from physical exertion, contact with people or equipment, facility conditions, weather, transportation, negligent acts or omissions of others, or emergency situations.
You knowingly and voluntarily assume all risks, known and unknown, that may arise from or relate to a session, travel to or from a session, communications with trainers, use of facilities, or participation in any activity arranged through BullDawg.
You represent that the minor participant is physically able to participate in the requested activities or that you have chosen to allow participation despite any condition or limitation. You are responsible for disclosing relevant health, injury, allergy, medication, or supervision needs to the trainer as appropriate.
In an emergency, you authorize emergency medical care for the minor participant if you cannot be reached promptly. You understand that you are responsible for medical costs, insurance deductibles, and related expenses.
To the fullest extent permitted by law, you release and waive claims against BullDawg and its affiliates, officers, directors, employees, contractors, licensors, and service providers arising out of or related to:
This release is intended to apply to claims based on negligence to the fullest extent permitted by law, but it does not waive rights that cannot lawfully be waived.
You understand that trainers on BullDawg are independent providers and not employees, agents, or representatives of BullDawg. BullDawg does not guarantee a trainer's conduct, quality of instruction, safety practices, credentials, or results.
You represent that:
You agree to defend, indemnify, and hold harmless BullDawg and its affiliates, officers, directors, employees, contractors, licensors, and service providers from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to:
A trainer may not record or distribute identifiable images, audio, or video of a minor participant through a BullDawg-arranged session without the guardian's consent unless required for safety, legal, or incident-reporting reasons.
This Waiver is governed by Texas law, without regard to conflict-of-law principles. Any dispute arising out of or related to this Waiver must be brought exclusively in the state or federal courts located in Texas, and you consent to that jurisdiction and venue.
If any part of this Waiver is held unenforceable, the remaining provisions will continue to the fullest extent permitted by law.
